1. Introduction

These Terms and Conditions govern participation in land acquisition and allocation programs administered by ZIBAWU Trust. By applying for, registering for, or participating in any project or program offered by the Trust, applicants acknowledge that they have read, understood, and agreed to comply with these Terms and Conditions. These terms apply to all beneficiaries, including union members and external participants who access land allocation programs through the Trust.

2. Purpose of the Trust Programs

ZIBAWU Trust was established by the Zimbabwe Banking and Allied Workers Union to facilitate structured access to housing stands through collective negotiation, bulk acquisition, and installment-based payment models. The Trust identifies, negotiates, and allocates housing stands to eligible participants under defined financial and administrative arrangements.

3. Eligibility for Participation

Participation in any ZIBAWU Trust project is subject to eligibility criteria determined by the Trust. Eligibility may include:

  • Membership in the Zimbabwe Banking and Allied Workers Union
  • Submission of a completed application form
  • Acceptance of project-specific terms
  • Compliance with payment and administrative requirements

Union members may receive priority access or preferential terms where applicable. Non-members may be considered subject to availability and under separate commercial conditions. The Trust reserves the right to approve or decline applications at its discretion.

4. Application and Allocation

Submission of an application or registration of interest does not automatically guarantee allocation of a residential stand. Allocation of stands is subject to:

  • Availability within the project
  • Completion of application requirements
  • Payment of applicable registration or commitment fees

The Trust reserves the right to structure allocation processes in accordance with project capacity and beneficiary demand.

5. Payment Terms

Beneficiaries allocated residential stands shall be required to make payments in accordance with agreed payment structures. Payment arrangements may include:

  • Initial registration or commitment fees
  • Deposit payments
  • Monthly installment payments
  • Administrative charges where applicable

Installment periods may extend for a minimum of five (5) years or as specified for a particular project. Beneficiaries must adhere strictly to payment schedules agreed with the Trust.

6. Default and Non-Payment

Failure to comply with payment obligations may result in administrative action by the Trust. Such action may include:

  • Issuance of payment reminders or notices
  • Temporary suspension of beneficiary rights within the project
  • Reallocation of the stand where persistent default occurs
  • Application of administrative penalties where applicable

Specific procedures relating to payment default will be outlined in project agreements issued to beneficiaries.

7. Land Development and Infrastructure

Where projects involve serviced or developing land, infrastructure development timelines may depend on coordination with:

  • Local authorities
  • Utility providers
  • Planning authorities
  • Contractors and service providers

While the Trust will endeavor to facilitate progress on development matters, certain aspects may be subject to external regulatory and logistical processes. Timelines for infrastructure development may therefore vary between projects.

8. Ownership and Title

Allocation of a stand through ZIBAWU Trust does not automatically constitute full legal ownership. Ownership processes may be subject to:

  • Completion of payment obligations
  • Compliance with regulatory requirements
  • Issuance of appropriate title or ownership documentation
  • Completion of administrative procedures

Beneficiaries shall comply with all processes required to facilitate lawful transfer or recognition of ownership.

9. Transfer, Resale, or Subdivision

Beneficiaries may not transfer, resell, or otherwise assign rights to an allocated stand without prior written approval from the Trust. Unauthorized transfers or speculative resale activities may result in administrative action by the Trust.

10. Acceptance of Terms

Participation in any ZIBAWU Trust program constitutes acknowledgment and acceptance of these Terms and Conditions. Applicants and beneficiaries are advised to review all documentation carefully before entering into any agreement with the Trust.
